Contrary to recent claims, it is not uncommon for a president to nominate a Supreme Court replacement in a presidential election year. And, it is not uncommon for the Senate to confirm the nominee – when the Senate is controlled by the party of the President.
Of the ten times the Senate and the President were of the same party and considered an election year nominee, senators voted to confirm eight times. The seat was almost never filled when the Senate and President have been of opposing parties.
In 2016, President Obama was not up for re-election, and the Senate was led by the opposing party. As in the past, the Senate did not fill the vacant seat.
That is not the case this time, and both the Senate and the President have the right to fill the vacant U.S. Supreme Court seat.
